Immigration Law

Immigration and Nationality Act (INA)

Enacted in 1952, the Immigration and Nationality Act is the major statute governing immigration law.

Public Law 82-414 / Chapter 477, 82 Congress. 66 Stat. 163 (1952)

Other Federal Statutes

While the INA is the major federal immigration statute, several other federal statutes deal with immigration:

Federal Regulations

Federal regulations on immigration are principally found in the following Code of Federal Regulations titles: Title 8, Aliens & Nationality, Title 20, Employees' Benefits, Title 22, Foreign Relations, and Title 28, Judicial Administration. Notices and proposed rules are first published in the Federal Register and are often found on the federal agency's website.

State Statutes and Regulations

While immigration laws come from the federal government, states also have laws that create rules for certain state activities related to immigration. Typically these state laws and regulations are related to employment, education, licensing, and state benefits.
